In this section we will be highlighting areas of our contract that represent frequently asked questions.

8.2       ALL PERMANENT UNIT MEMBERS SHALL BE EVALUATED EVERY TWO (2) YEARS SOMETIME DURING THE MONTH OF APRIL, UNLESS NEEDED MORE OFTEN BECAUSE OF JOB PERFORMANCE.   THE WRITTEN EVALUATION SHALL BE BASED ON THE OBSERVATIONS AND KNOWLEDGE OF THE EVALUATOR.   THE EVALUATOR SHALL SCHEDULE A CONFERENCE ON 48-HOUR NOTICE TO REVIEW THE EVALUATION WITH THE UNIT MEMBER.

Explanation of this language means as an employee you should expect

  • Performance evaluation other year unless you have received unsatisfactory marks, and in that case, it can be done every year

  • your evaluation should be in writing

  • the evaluation should take place in April

  • you should be given 48 hours advance notice of the meeting.

8.2.2    IN THE EVENT A UNIT MEMBER DOES NOT RECEIVE AND EVALUATION, THE ABSENCE OF SAID EVALUATION SHALL BE CONSIDERED A SATISFACTORY EVALUATION FOR PURPOSE OF THIS ARTICLE.

Explanation of this language means

  • If you do not receive an evaluation, you should not be evaluated again for 2 years


An example, we had 31 members who were due for evaluations in April of 2020.  Due to the COVID closure, those 31 employees were not evaluated.   The Union contacted the District and required enforcement of our contract language and those 19 employees will not now be evaluated until the 21/22 school year.   Our contention was that even though schools were closed, those employees had been working for two years since their last evaluation and certainly could have gone through the evaluation process remotely, like we were doing everything else.   This is an example of how your Union works for you.
